AGREEMENT
This Agreement is made BETWEEN SONJA'S ANGELS (“the Agency”, “we” or “us”) of PO Box 517, Kogarah NSW 1485 AND
(Name and Address of Parent or legal Guardian) (“the Parent” or “you”)
on (date).
This Agreement sets out the terms and conditions on which the Agency will assist the Parent in finding a carer for their child/children.
1. The Agency is a booking and referral agency only. It does not employ carers.
2. We will:
(a) assist you in locating a carer to provide an in-home child care service for your child/children;
(b) assess the experience, professional ability and suitability of carers in accordance with the criteria supplied by you;
(c) refer suitable carers to you for your approval.
3. Once a suitable candidate has been selected by you, you are required to enter into a temporary or permanent employment agreement (as appropriate) with the carer.
4. We reserve the right to refuse a placement for any reason whatsoever.
5. You are responsible for:
(a) final selection and approval of a carer;
(b) verification of individual references and work experience in respect of any Nanny applicant prior to engagement;
(c) fulfilling all obligations as an employer (unless the Carer specifically provides you with evidence that s/he is a private contractor), including, where applicable, compliance with industrial relations legislation and including payment of;
(i) Worker's Compensation insurance;
(ii) Occupational Health and Safety requirements;
(iii) Taxation, and
(iv) Superannuation;
(d) providing a safe and clean environment for the carer;
6. Fees and Charges:
You will:
(i) provide us with a valid credit card number and agree to charges being made against it in accordance with this agreement unless alternative arrangements have been made;
(Ii) pay all wages for trial and casual carers at the end of each day;
(iii) pay all agency fees as within 7 days of invoice.
7. If payment is not made:
(a) the Agency may charge the fees to the credit card supplied by you;
(b) charge interest on fees outstanding after 7 days, calculated at 10% per annum on a daily basis until payment.

8. Replacement Guarantee
(a) If, within 3 months of the start date:
(i) you find the carer unsuitable;
(ii) the carer resigns;
(Iii) the carer's engagement is terminated by you or by us;
the Agency will provide one replacement carer provided that there are no fees and charges outstanding
to the Agency. (“the Replacement Guarantee”).
(b) We will use our best efforts to refer suitable qualified carers to you, but we do not guarantee performance or client satisfaction with any individual carer and do not offer refunds. The only compensation available in relation to an unsuitable carer or one who resigns or has his/her engagement terminated is the Replacement Guarantee specified in paragraph 8(a).
(c) The Replacement Guarantee is null and void if payment is not made within 14 days of invoice.
9. Confidential Information and privacy
(a) All information provided to or by the Agency is strictly confidential, and should not be disclosed to third parties.
(b) If you disclose information to a third party which results in a carer referred to you being engaged in any capacity by the third party, you are liable to pay us the applicable fee.
10. Indemnities
You are liable to indemnify:
(a) the Agency against any fine, penalty or loss arising out of any failure to comply with sub-par 5(c); and
(b) the Agency, and any carers referred by us to you, against any loss, injury, damage, cost or claims for compensation whatsoever arising out of:
(i) any loss of property;
(ii) any injury, or
(iii) any act , omission or negligence by the Agency.
11. Applicable Law
This agreement is governed by the law of New South Wales.
